1. About these terms

These Terms of Service apply to your use of the Cuisvera website at cuisvera.com and to any order you place with us. By using the website or placing an order, you agree to these terms, together with our Shipping Policy, Refund Policy and Privacy Policy. Please read them carefully. "We", "us" and "our" mean Cuisvera; "you" means the person using the website or placing the order.

2. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.

3. Using the website

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to give accurate and complete information when you check out and to keep your account details secure. You must not use the website for any unlawful purpose, to interfere with its operation or security, to upload malicious code, or to collect information about other users.

4. Products and descriptions

We try to describe and photograph every product accurately, including materials, dimensions, capacities and care instructions. Colours can look slightly different on different screens, and handmade or natural materials such as timber and stoneware can vary a little from piece to piece. Please read the product page and the manufacturer's instructions before using a product. If a product is not as described, you can return it as set out in our Refund Policy.

5. Prices and payment

All prices are in Australian dollars (AUD) and include GST. Standard delivery within Australia is free. Prices and availability may change without notice, but a change will not affect an order we have already accepted. Payment is taken when you place your order through our secure checkout, using the payment methods shown at checkout. We do not store full card details.

6. Orders and acceptance

Your order is an offer to buy. We accept it when we dispatch the goods. We can refuse or cancel an order in limited situations, such as when stock has run out, when a listing shows a clear pricing or description mistake, or when a payment looks fraudulent. If we cancel an order after you have paid, we refund you in full.

7. Delivery

We deliver within Australia only. Delivery timeframes are estimates and are explained in our Shipping Policy. Risk in the goods passes to you on delivery, and ownership passes once we have received full payment.

8. Returns and refunds

Change-of-mind returns, faulty items and refunds are covered by our Refund Policy, which forms part of these terms.

9. Discount codes

Discount codes such as WELCOME10 work only under the conditions published with them, have no cash value, and cannot be stacked with other codes unless we state that they can. We may withdraw a code that is being misused.

10. Intellectual property

The content of this website, including text, photographs, graphics and our logo, belongs to us or our licensors. You may view and print it for personal, non-commercial use only. You must not copy, reproduce or republish it without our written permission.

11. Reviews, comments and feedback

If you send us comments, ideas or reviews, you confirm they are your own honest opinion, are not unlawful or misleading, and do not infringe anyone else's rights. We may use feedback to improve our range and service without any obligation to you.

12. Links to other websites

Our website may link to third-party websites, such as carrier tracking pages. We do not control those websites and are not responsible for their content or practices.

13. Limitation of liability

Subject to the Australian Consumer Law and clause 2, we are not liable for any indirect or consequential loss arising from your use of the website or our products. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.

14. Events outside our control

We are not responsible for delays or failures caused by events reasonably beyond our control, including carrier and postal disruptions, customs or regulatory holds, extreme weather, natural disasters, pandemics, industrial action, power or internet outages, and acts of government. We will let you know as soon as practical and do what we reasonably can to reduce the impact. If the delay is significant, you may cancel your order for a full refund.

15. Taxes and charges

Our prices include GST. Because we deliver within Australia only, we do not expect any further taxes, duties or customs charges to apply to your order. If any government charge applies that we have not included, we will tell you before we accept your order.

16. Privacy

We handle your personal information in line with our Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Marketing emails are only sent with your consent, in line with the Spam Act 2003, and every one includes an unsubscribe link.

17. Changes to these terms

These terms are reviewed and updated occasionally. Each order is governed by the terms published here on the date it is placed.

18. Governing law

The laws in force in Australia govern these terms. You and we submit to the non-exclusive jurisdiction of the Australian courts.
